Please read these terms carefully before using Statty AI.
1. Acceptance of Terms
These Terms and Conditions ("Terms") constitute a legally binding agreement between you and Statty AI regarding your use of our AI-powered analytics platform for Shopify stores.
By installing, accessing, or using Statty AI, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not install or use our services.
These Terms apply to all users, including but not limited to Shopify store owners, administrators, and authorized users who access Statty AI through your account.
Important Notice
You must be at least 18 years old and have the legal capacity to enter into contracts to use Statty AI. By accepting these Terms, you represent and warrant that you meet these requirements.
2. Service Description
Statty AI is a Shopify application that provides AI-powered analytics, insights, and recommendations for e-commerce businesses. Our services include:
Product Analytics
Comprehensive product performance tracking and optimization insights
Order Intelligence
Real-time order tracking and revenue analysis
Customer Insights
AI-powered customer segmentation and behavior analysis
AI Recommendations
Predictive analytics and actionable business recommendations
Service Modifications: We reserve the right to modify, suspend, or discontinue any aspect of our services at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.
3. Account Registration and Security
3.1 Account Creation
To use Statty AI, you must install the application through the Shopify App Store and connect it to your Shopify store. By doing so:
- You authorize Statty AI to access your Shopify store data as specified during installation
- You agree to provide accurate and complete information
- You must be the authorized owner or administrator of the Shopify store
- You accept responsibility for all activities that occur under your account
3.2 Account Security
You are responsible for maintaining the security of your account:
Password Protection
Keep your Shopify login credentials secure and do not share them with unauthorized parties
Unauthorized Access
Notify us immediately if you suspect any unauthorized access or security breach
Account Liability
You are liable for all activities conducted through your account, whether authorized or not
4. Subscription and Billing
4.1 Free Trial
Statty AI offers a free trial period with limited features. During the trial, you can access basic analytics functionality. No payment information is required for the free trial.

4.3 Billing Terms
- Billing Cycle: Subscriptions are billed monthly or annually, depending on your selection
- Payment Method: All payments are processed through Shopify's billing system
- Auto-Renewal: Subscriptions automatically renew unless cancelled before the renewal date
- Price Changes: We reserve the right to modify pricing with 30 days' notice
- Taxes: Prices exclude applicable taxes, which will be added at checkout
4.4 Refund Policy
All subscription fees are non-refundable except as required by law. If you cancel your subscription, you will continue to have access until the end of your current billing period.
We may offer refunds on a case-by-case basis for technical issues or service failures. Contact our support team within 7 days of billing for refund requests.
5. User Obligations and Acceptable Use
As a user of Statty AI, you agree to:
Comply with Laws
Use our services in compliance with all applicable laws, regulations, and industry standards
Maintain Security
Implement reasonable security measures to protect your account and store data
Provide Accurate Information
Ensure all information provided to us is accurate, current, and complete
Report Issues
Promptly notify us of any bugs, security vulnerabilities, or unauthorized access
Respect Third Parties
Not infringe on the intellectual property or privacy rights of others
6. Prohibited Activities
You agree NOT to engage in any of the following prohibited activities:
Unauthorized Access
Attempt to access, probe, or test the vulnerability of our systems or networks
Reverse Engineering
Decompile, reverse engineer, or attempt to extract source code from our application
Data Scraping
Use automated systems to scrape, mine, or collect data from our platform
Service Disruption
Interfere with or disrupt the integrity or performance of our services
Reselling
Resell, sublicense, or redistribute our services without explicit written permission
Fraudulent Activity
Use our services for any fraudulent, illegal, or unauthorized purposes
Malicious Code
Transmit viruses, malware, or any code that could harm our systems or users
Consequences of Violations
Violation of these prohibited activities may result in immediate termination of your account, legal action, and/or reporting to law enforcement authorities.
7. Intellectual Property Rights
7.1 Our Intellectual Property
All content, features, functionality, and intellectual property in Statty AI, including but not limited to:
- Software code, algorithms, and AI models
- User interface, design elements, and graphics
- Trademarks, logos, and brand elements
- Documentation, guides, and educational content
are owned by Statty AI and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use our services for your business purposes only.
7.2 Your Data
You retain all rights to your store data. By using Statty AI, you grant us a limited license to:
- Process your data to provide analytics and insights
- Use aggregated, anonymized data for service improvement
- Store and backup your data for service continuity
8. Data Usage Rights
Your use of Statty AI is subject to our Privacy Policy and the following data usage terms:
Data Ownership
You own all data from your Shopify store. We do not claim ownership of your business data, customer information, or sales records.
Aggregated Data
We may use aggregated, anonymized data for statistical analysis, benchmarking, and improving our AI models. This data cannot be used to identify individual users or stores.
Data Portability
You can export your data from Statty AI at any time in standard formats (CSV, Excel, PDF). We facilitate data portability as required by applicable laws.
Data Deletion
Upon account termination or at your request, we will delete your personal data within 90 days, except where retention is required by law.
9. Service Availability and Maintenance
We strive to provide reliable and uninterrupted service, but we cannot guarantee 100% uptime.
Uptime Commitment
We target 99.9% uptime for our services, measured monthly
Excludes scheduled maintenance and force majeure events
Scheduled Maintenance
We perform maintenance during low-traffic periods
Advance notice provided for major maintenance
Service Interruptions
We are not liable for service interruptions beyond our control
Includes third-party failures, natural disasters, etc.
Support Response
24/7 monitoring with support response within 48 hours
Priority support available for Enterprise plans
10. Warranties and Disclaimers
IMPORTANT DISCLAIMER
STATTY AI IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
We Do Not Warrant:
- That our services will be uninterrupted, timely, secure, or error-free
- The accuracy, completeness, or reliability of any content, data, or insights
- That defects will be corrected or that our services are free from viruses
- Any specific results or outcomes from using our AI-powered recommendations
AI-Generated Insights: Our AI provides recommendations based on data analysis. These are suggestions only and should not be considered professional business advice. You are solely responsible for business decisions made based on our insights.
11. Limitation of Liability
LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, STATTY AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

12. Indemnification
You agree to indemnify, defend, and hold harmless Statty AI, its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

13. Termination
13.1 Termination by You
You may terminate your account at any time by uninstalling Statty AI from your Shopify store or contacting our support team. Upon termination:
- You will retain access until the end of your current billing period
- No refunds will be provided for unused portions of paid subscriptions
- Your data will be retained for 90 days before permanent deletion
13.2 Termination by Us
We reserve the right to suspend or terminate your account immediately, without prior notice, if:
You violate these Terms or our Acceptable Use Policy
You engage in fraudulent or illegal activities
Your account poses a security risk to our platform or other users
Payment failures or chargebacks occur
13.3 Effect of Termination
Upon termination, all rights and licenses granted to you will immediately cease. Sections of these Terms that by their nature should survive termination (including liability limitations, indemnification, and dispute resolution) will remain in effect.
14. Dispute Resolution
14.1 Informal Resolution
Before filing a formal claim, you agree to contact us at support@stattyai.com to attempt to resolve the dispute informally. We will work in good faith to resolve any disputes within 30 days.
14.2 Arbitration Agreement
If informal resolution fails, any dispute arising from these Terms or our services shall be resolved through binding arbitration, rather than in court, except that you may assert claims in small claims court if they qualify.
The arbitration will be conducted by a neutral arbitrator in accordance with the rules of the American Arbitration Association (AAA). The arbitrator's decision will be final and binding.
14.3 Class Action Waiver
You agree that any arbitration or proceeding shall be limited to the dispute between you and Statty AI individually. To the fullest extent permitted by law, you waive your right to participate in a class action lawsuit or class-wide arbitration.
15. General Provisions
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of Delaware, without regard to conflict of law principles.
Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Statty AI regarding our services and supersede all prior agreements.
Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force.
No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. Any waiver must be in writing and signed by an authorized representative.
Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign our rights and obligations without restriction.
Notices
All notices to you will be sent to the email address associated with your account. Notices to us must be sent to support@stattyai.com.
